Legal Perspectives from EDO Tasmania
18 June 2014: EPA ordered to provide reasons for Shree permit change to Save the Tarkine
EDO Tasmania appeared on behalf of Save the Tarkine in the Tasmanian Supreme Court today.
Save the Tarkine wrote to the Director of the Tasmanian EPA in December 2013 asking for reasons for his decision to alter the permit conditions imposed by the EPA Board on the Shree Minerals iron ore mine in the Tarkine. The altered conditions relate to the way in which potentially acid-forming material is handled at the mine.
The Director refused to give reasons saying Save the Tarkine did not have a sufficient interest in the issue.
Seven months later, in court today, the EPA Director conceded Save the Tarkine does in fact have a sufficient interest.
The Court ordered the Director to provide reasons by 2 July 2014.
